Minister of Solid Minerals Cautions States on Illegal Mining Shutdowns

The Minister of Solid Minerals Development, Dele Alake, has issued a stern warning to state governments, emphasizing that they lack the constitutional authority to shut down mining operations. He reiterated that mining activities fall exclusively under the jurisdiction of the Federal Government and urged states to refrain from unilateral actions in this regard.

This declaration comes in response to recent moves by the state governments of Gombe, Kogi, and Osun. Notably, the Osun State Government recently ordered the closure of Segilola Mining Company, citing taxation and operational concerns.

Alake, addressing the controversy, stated, “No state has the authority to interfere in mining operations. It is a constitutional matter. Mining falls under the exclusive legislative list, which is the domain of the Federal Government. Any form of state interference in mining operations is both illegal and disruptive.”

The minister further warned that the closure of mining operations by state governments could harm the country’s reputation among foreign investors and lead to potential divestments by established companies. He urged subnational governments to consult with the Ministry of Solid Minerals before taking actions that could negatively impact the sector.

Alake’s remarks underline the importance of adherence to constitutional provisions to avoid creating uncertainty in the mining industry and maintain Nigeria’s attractiveness for foreign direct investment.
