Rivers State High Court Adjourns Gov. Fubara’s Case Indefinitely

A Rivers State High Court sitting in Port Harcourt has adjourned indefinitely the suit filed by Governor Siminalayi Fubara and his Deputy, Professor Ngozi Ordu, challenging the impeachment processes initiated against them by the Speaker and members of the Rivers State House of Assembly.
The case, presided over by Justice Florence Fiberesima of the Oyigbo High Court, involves the Speaker of the Rivers State House of Assembly, Martin Chike-Amaewhule, twenty-six other lawmakers, and the Clerk of the House, who are listed as defendants.
At the resumed hearing, lead counsel to the Speaker and twenty-seven other members of the House of Assembly, S. I. Amen, SAN, informed the court that an appeal had been entered in the matter. He subsequently made an oral application requesting the court to halt further proceedings pending the determination of the appeal by the appellate court.
The application was not opposed by the lead counsel to the claimants, Paul Orikolo, SAN. Similarly, Lawrence Oko-Jaja, counsel to the twenty-eighth to thirtieth defendants — Oko Jumbo, Sokari Goodboy, and Orubienimigha Timothy — also raised no objection to the application.
In her ruling, Justice Fiberesima adjourned the matter indefinitely after confirming that two separate appeals had been duly entered. She noted that the decision would allow the Court of Appeal to first determine the issues placed before it, in line with established judicial procedure.
The development follows an earlier ruling by a Rivers State High Court sitting in Oyibo Local Government Area, Port Harcourt, which granted an interim order of injunction against the Speaker of the Rivers State House of Assembly, Martin Chike-Amaewhule, and thirty-two others. Those affected by the order included the Clerk of the House and the Chief Judge of Rivers State.
The interim injunction restrained the Speaker and twenty-seven other lawmakers from forwarding any articles of impeachment or related documents to the Chief Judge for the purpose of constituting a panel to investigate allegations of gross misconduct against Governor Fubara and his deputy.
With the indefinite adjournment, all eyes are now on the appellate court, whose decision is expected to determine the next phase of the legal and political dispute in Rivers State.
