May 8 Set For Sowore’s “No Case Submission” As Court To Determine Next Phase

May 8 has been fixed as a crucial date in the ongoing legal proceedings involving activist and politician, Omoyele Sowore, as his legal team prepares to argue a “no case submission.”
The application challenges the sufficiency of evidence presented by the Department of State Services (DSS), contending that the prosecution has failed to establish a prima facie case against the defendant.
A “no case submission” is a legal argument made by the defence, asserting that the prosecution’s evidence is too weak to warrant further proceedings. If upheld, the court may dismiss the charges without requiring the defendant to present a defence.
However, if the court rules that a prima facie case has been established, Sowore would be required to open his defence and respond to the allegations in full.
Legal analysts note that a prima facie finding does not amount to a conviction but merely indicates that there is sufficient evidence for the case to proceed to the next stage.
The outcome of the May 8 hearing is expected to determine whether the case will be dismissed or advance to the defence stage, where witnesses may be called and further arguments presented.
